Support Mallory's Law 

Mallory’s Law is a tough, Drunk Driving Child Endangerment Law that adds "Double" the fines and penalties associated with a Driving Under the Influence (DUI) offense, as well as a Mandatory Child Abuse Charge if the child being transported is injured or killed.

Below is a breakdown of Mallory’s Law, the proposed Drunk Driving Child Endangerment Law designed to help tackle the major issue of driving drunk with minors in the car. 


FLORIDA LAW PROPOSAL
MALLORY'S LAW

For a Driving under the influence (DWI/OUI) offense while transporting a passenger under age 18 in the vehicle, the following sanctions apply:

  • Double the current fines for a standard DWI or OUI offense.
  • Double the current jail sentences (Minimum 48 hours for first offense).
  • Mandatory 100 hours of community service benefiting children. (Currently 50 hours. No option of additional fines in lieu of service)
  • Mandatory Parenting Class (In addition to the required DUI School and advanced driver improvement courses).

In addition to the above, a person is Guilty of Child Abuse if they knowingly or recklessly commit an act that either kills or injures a transported passenger under 18 years old while operating under the influence (DWI/OUI). The following additional sanctions shall apply:

  • For each injury, a MANDATORY sentence of 45 days to 7 years * in jail.  * based on severity of injury.
  • For each fatality, a MANDATORY sentence of 8 to 15 years in jail.
  • Additional fines of $10,000 to $50,000 * per injured or killed child.
  • Require installation of alcohol ignition interlock device on vehicles used by the offender to transport children.
  • Mandatory 200 hours of community service benefiting children. (Currently 50 hours. No option of additional fines in lieu of service).
